Maintenance Agreement Terms & Conditions
A. GENERAL TERMS AND CONDITIONS
1. Annual Maintenance charges are payable in advance. In addition to the annual charges, any local taxes, such as sales tax etc. may be levied at the time of agreeing to the contract may be charged at actual if applicable.
2. This agreement is initially for a period of one year commencing from the date of payment of maintenance charges.
3. The amount of maintenance that shall be provided is limited to the time outlined in the product purchased (12, 6 or 3 hours respectively)
4. No work shall be undertaken on Sunday, Bank Holidays or outside the office hours of Quay Computer Services except by prior arrangement and at additional charge to the customer on a “Per Call Basis” at the standard rates currently in effect then.
5. Quay Computer Services engineer may be allowed to take the faulty component to the Test and Repair Centre for due repairs if the need arise.
6. During the period of maintenance agreement the machine will not be relocated (or) transported without permission from Quay Computer Services, and on such condition Quay Computer Services reserve its right to terminate this agreement forthwith. On such termination, Quay Computer Services shall have no obligation or liabilities arising out of this agreement and the customer shall have no right to claim any refund or compensation.
B. SERVICES
1. Quay Computer Services shall provide the following services:
a) Troubleshooting and diagnosis to help with general computer problems.
b) Preventive maintenance based on the specific need of each unit of the equipment as determined by company. Unscheduled on-site remedial maintenance, on request for repairing functions including reasonable replacement of unserviceable parts. The parts replaced will be new parts or parts equivalent to new in performance. These parts shall be furnished on an exchange basis. The removed parts will become the property of Quay Computer Services.
c) Quay Computer Services will make home visits upon request within a 6 mile radius of Backwell, Bristol only. Remote Access (full terms and conditions here), email and phone support can be provided to any location.
d) Quay Computer Services will provide a ‘Best Possible’ resolution to your problem. We are here to help and will try all we can before offering a workaround solution.
2. The customer shall provide the following:
a) Full and free access to the computer to provide service thereon.
b) A working Broadband internet connection.
3. The obligation of Quay Computer Services under this agreement excludes.
a) Any major upgrading of the machine.
b) Any major failure of Hard Disks and monitor picture tubes, or monitor display panels
c) Any work external to the machine, such as maintenance of non Quay Computer Services attachments, accessories etc.
d) Repair of malfunction or damage due to accident, transportation, neglect, failure due to use of non-standard electrical power, air-conditioning or parts, Works due to alteration in machines by persons other than Quay Computer Services personnel.
C. TECHNICAL TERMS AND CONDITIONS
1. Your Annual Maintenance Contract shall not cover the replacement of components or parts but will be limited to preventive and diagnostic calls meant for the repair of the machine.
2. Under your Annual Maintenance Contract the cost of replacement of parts or components needed for repairs shall be borne by the customer at cost. An estimate of such cost will be provided by Quay Computer Services. The customer is free to by these parts or components himself and make it available to Quay Computer Services or may ask Quay Computer Services to arrange for these procurements.
3. Under the AnnualMaintenance Contract Quay Computer Services may replace minor components to repair the machine without any cost to the customer at its own discretion.
4. Quay Computer Services is not responsible for any machine problem such as machine hanging, slow speed due to Software’s, Virus problem and any major failure of Hard disk drive, monitor picture tubes, monitor displaypanels and Printer Heads.
